The new EWC directive 2009/38/EC: Recommendations on negotiating during the transposition period (5 June 2009 to 5 June 2011)
These common recommendations, drafted by the European Trade Union Sector Federations, are intended to provide guidance to negotiators on how to anticipate the changes of the new EWC directive during the transposition period of this Directive: how to ensure that new and renegotiated agreements benefit from all the improvements in the new Directive; and how to support colleagues faced with management attempts to fast-track negotiations or renegotiations in order to circumvent the new obligations.
These recommendations were jointly developed by the following European Federations: EMF, EMCEF, ETUF:TCL, Uni Europa, EPSU, EFFAT, EFBWW and ETF.

Infopoint database "analysis of the EWC agreements 2004-2008"

The anuual report on analysis and evaluation of the most innovative experiences
on the enforcement and functioning of EWCs. This information brochure, with tables
based on the quantitative and qualitative analysis of the Infopoint database of
European Works Council agreements, is aimed at offering some guidance as to which
clauses should be included in an EWC agreement and those which should be avoided.
It especially underlines the last four-year period which has seen the affirmation
and consolidation of a generation of EWC agreements that have significantly innovated
the content of previous agreements.

Information Report of the EWC Workshop “Update of qualifications
and skills of EWC members” in Warsaw on 26th May 2008.
In the framework of the Infopoint project, SDA publishes the working documents of
the workshop on how to improve qualifications and skills for EWC members, held in
Warsaw in May 2008. The workshop involved EWC members who presented first-hand experiences
of different training they received. On the other side trade union and external
experts give important hints of how to improve different competences of EWC members,
e.g. through financial training, training for the improvement of working conditions
or language training. The report is available in English, French, German,
Polish and Czech.

Information Report of the EWC Workshop “Information and
Consultation Rights in Jurisprudence”, Brussels, 12 march 2008
In the framework of the Infopoint project, SDA publishes the working documents of
the workshop on the national law cases and the law cases of the European Court of
Justice related to EWC, held in Brussels in March 2008. From the first-hand experiences
of the EWC representatives taking part to the workshop and under the guide of Brian
Bercusson, case law has been analysed. The documents represent an important starting
point in order to design a trade union strategy also in the legal field, aimed at
trying to take advantage of the positive outcomes and to face the difficulties in
having workers' rights recognised.

NEW Vademecum on the submission of a project on 04030303
budget line 2008 This publication is a guide for the social partners
intending to submit a project under the 04030303 EC budget line. It provides assistance
to any eligible promoter throughout the preparation of the bid. It covers various
aspects of the project preparation work, including an explanation of the objectives
of the call for proposals; practical hints on how to deal with the SAGA form; useful
tips about how to structure a project description and to estimate a budget. The
text also includes examples of awarded projects.

GENDER RELATED ISSUES: GOOD PRACTICES WITHIN EUROPEAN WORKS COUNCILS 2007
The paper, elaborated in the framework of the Infopoint project, gives an overview
of the state of implementation of the principle of gender equality in the experience
of EWCs.
Based on an in-depth analysis of both the EWC agreements and the social charters
negotiated by the EWCs currently in force, it focuses on the issue of equal opportunities
under a double point of view: both as a criterium to increase the presence of women
in workers' representation bodies, and as a theme of competence of EWCs, object
of information and consultation.
Keeping into consideration the existing literature and quoting specific cases in
depth, the paper underlines the importance of the implementation of gender equality
in EWCs, not only in order to tackle the lack of female presence in these workers'
representation bodies, but also to broadly affirm the gender perspective, boosting
gender mainstreaming in all the work-related topics of their competence.

Effectiveness of workers' information and consultation rights in Europe - methods
of action for EWCs
This publication was elaborated in the framework of the INFOPOINT project, and was
presented as a working document for the EWC conference held in Brussels on 20 April
2007. This paper analyses four cases of EWCs having coped with restructuring processes
(General Motors, Inbev, Dim BA, RWE), highlighting both good and bad practice, and
drawing some methods of action allowing EWCs to make the most effective use of their
information and consultation rights.

This publication was developed in the framework of the SDA Infopoint Project and
in cooperation with the ETUC. This publication will give an analysis of the Directive
2001/86/EC on employees´involvement in SE as its objective is, as the name “handbook”
indicates, to give assistance to those who will deal either as trade unions officials
or employees´ representatives with negotiations on employees´ involvement in the
European company. It is addressed to those who have already a basic knowledge on

Paths to Progress: Acta and Contributions of the Paths to Progress Project 2006
The Path to progress project was run between 2005 and 2006 to map the innovation
in the fields of information, consultation and participation under the Commission's
04.03.03.03 budget line. Under this project, an "innovation expert group" composed
of academics and other experts were asked to generate new ideas on the new trends
which could improve the management of information, consultation and participation
of employees in Europe in the context of the development and competitiveness strategies
of the most prominent industrial sectors, and on the need to deal with company restructuring,
mergers, take-overs and relocations. This collective work was co-ordinated by Prof.
Brian Bercusson from London King's College. The summaries of the contributions have
been translated in a number of languages, including Polish and Czech. The French
and German short versions can be found after the English version.

Analysis of the SDA INFOPOINT database "EWC AGREEMENTS", 2006
This is a quantitative and qualitative analysis of the SDA database of European
Works Councils agreements. The analysis will illustrate the relevance of the different
criterions in which the included agreements are broken down. It wants to illustrate
the possible consequences of including or excluding certain clauses in an EWC agreement.
In addition it offers a few on most recent formal trends and evolutions to be discovered
in agreement. Overall it can serve as an interpretation guide to the database.

Case Study on Best Practices in EWC Functioning, 2006
This case study is focusing on the most relevant cases of functioning of
European Works Councils. It wants to comment on practices in the involvement or
non-involvement of European Works Councils in accompanying restructuring of multinational
enterprises, enlargement of the Council itblank due to the accession of the new
EU Member States and the possible role of EWCs in the establishment and the monitoring
of certain types of codes of conduct and/or framework agreements.

Your New EWC Agreement, 2005
This publication is a guide for negotiating and renegotiating EWC agreements in
the interests of workers. It is written in an explanatory 'user friendly' style
designed to help workplace representatives and trade union officers define their
positions during negotiation and to ensure that they have examined the main possibilities
and consequences of a new agreement before they sign. The text is enhanced with
graphics giving key statistics from the SDA's EWC agreement database. It also includes
text-boxes highlighting relevant parts of the Directive.

The European Company - Prospects for worker board-level participation in the enlarged
EU (edited by Norbert Kluge and Michael Stollt) 2005
Since October 2004 companies have been able to set up a European Company (Societas
Europaea, SE). Under the new EU regulations, companies may opt voluntarily for these
European rather than national company statutes which enable them to operate in Europe
on a cross-border basis under the same corporate regime. The new booklet provides
information on different aspects of the European Company (SE) such as the question
of worker involvement, the national transposition processes and taxation aspects.
Moreover, information is given on the development and the different national systems
of worker participation on supervisory or administrative boards throughout the European
Union.
The purpose of this booklet is above all practical: it is intended for everyone
who needs information about the SE and about existing systems of worker board-level
participation in the now 25 EU member states. The idea is to give readers an insight
into the national backgrounds and experiences of those colleagues who sit down with
management and jointly negotiate the question of worker involvement in the coming
SE.

Filling in the Gaps, 2005
This publication was written as part of the ‘Mind the Gaps’ project, supported by
European Commission budget line 04.03.03.03. It attempts to help trade unionists
and employee representatives in countries with no tradition of workplace information
and consultation bodies (particularly the UK and Ireland) to make the most of the
new information and consultation rights that they have as a result of Directive
2002/14/EC. It looks at how such rights are put into practice in seven countries
with different experiences in this area (Belgium, France, Germany, Hungary, Italy,
Slovenia and Sweden), concentrating on three key topics: available information and
how it is used; relationships between trades unions and ‘works councils’; and ‘practicalities
and resources’.

Revising the EWC Directive, 2004
This publication puts together a collection of documents that should be useful for
those who wish to follow the debate on revision of the EWC Directive. Most of the
content consists of reproductions of official public documents, such as the Commission’s
first phase consultation paper or those already available online from the social
partners, such as the ETUC resolution. As such, they remain as valid points of reference
although the revision process is still underway. The text of the EWC Directive and
the text of the SE Directive are also provided in the annex.

This study, which has achieved undeniable success, consists of two parts: the first
contains educational material developed for training courses by the European Trade

Practice and Models of Financial Participation of Employees in the Companies in Europe
– A Comparative Analysis, Sindnova, ETUC-Infopoint, 1998.
This study illustrates different scenarios of financial and economic participation
of employees in the life and wealth of companies in Central European and Baltic
countries some time before their adhesion to the EU, giving comparisons with the
situation in the EU 15 countries. Employee shareholders are described in the growing
context of privatisation during this period in the different countries. The analysis
is illustrated with some case studies: Alitalia, Air France, Vivendi, Pliva, Telecom
Eireann etc.
